Terms of Service

PromptMaktaba is a SaaS platform for managing, optimizing, and sharing AI prompts. We provide tools to help you organize your prompts, enhance them with AI, and collaborate with your team.

What's Included

• Prompt library: Store and organize your AI prompts
• AI enhancement: Improve prompts using our AI tools
• Version history: Track changes over time
• Team collaboration: Share prompts with teammates (on paid plans)
• Platform launchers: Open prompts in ChatGPT, Claude, and other AI tools

What's Not Included

• AI responses: We don't provide AI chat interfaces, use our launchers to open prompts in your preferred AI platform
• Uptime guarantee: While we strive for 99.9% uptime, we don't guarantee continuous availability
• Technical support: Free plans include email support (3 business day response); paid plans include priority support

To use PromptMaktaba, you must create an account and keep it secure.

Your Responsibilities

• Age requirement: You must be at least 18 years old (or the age of majority in your jurisdiction)
• Accurate information: Provide truthful email and name during registration
• Secure password: Use a strong, unique password and keep it confidential
• Account security: You're responsible for all activity under your account, notify us immediately if you suspect unauthorized access
• One account per person: Don't create multiple accounts to abuse free tier limits

Allowed Uses

• Create, store, and manage AI prompts for personal or commercial use
• Share prompts with team members (on Team or Enterprise plans)
• Export your prompts at any time (your data is yours)
• Use our AI enhancement tools to improve your prompts

Prohibited Uses

• Illegal content: Don't store prompts that violate laws (hate speech, terrorism, child exploitation, fraud)
• Abuse our service: No spamming, scraping, or overloading our servers
• Resell our service: Don't rebrand or resell PromptMaktaba as your own product
• Reverse engineering: Don't attempt to copy our codebase or algorithms
• Violate others' IP: Don't upload copyrighted content without permission

PromptMaktaba offers a free tier and paid subscription plans (Pro, Teams, Enterprise).

How Billing Works

• Free tier: No credit card required, no hidden fees
• Paid plans: Billed monthly or annually via Stripe (our payment processor)
• Auto-renewal: Subscriptions automatically renew unless you cancel
• Prorated charges: If you upgrade mid-cycle, you'll be charged the prorated difference
• Cancellation: You can cancel anytime, your subscription remains active until the end of the billing period
• Refunds: No refunds for partial months, but you can downgrade or cancel to avoid future charges

Your Content (Prompts)

You own your prompts. PromptMaktaba claims no ownership of any content you upload or create. You retain all intellectual property rights.

Our Platform (Code & Design)

PromptMaktaba owns all rights to our platform code, design, logos, and features. You may not copy, modify, or distribute our platform without permission.

AI-Enhanced Content

When you use our AI enhancement tools, you own the enhanced prompts. Our AI tools use Azure OpenAI, we don't train our models on your data (per our Privacy Policy).

PromptMaktaba is provided "as is" without warranties of any kind. While we work hard to keep the service reliable and secure, we can't guarantee perfection.

What We're Not Liable For

• Service interruptions: Downtime due to maintenance, outages, or technical issues
• Data loss: We backup your data daily, but you should export important prompts regularly
• Third-party services: Issues with Clerk (auth), Stripe (payments), or Azure OpenAI (AI features)
• User-generated content: We're not responsible for prompts uploaded by other users
• Indirect damages: Lost profits, business interruption, or consequential damages

Termination by You

You can delete your account anytime from Account Settings. Here's what happens:

• 7-day grace period: You have a full week to cancel and restore your account
• Data deletion: After 7 days, all your prompts and personal data are permanently deleted
• No refunds: Subscription fees for the current billing period are non-refundable

Termination by Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You engage in fraudulent activity or payment disputes
• You abuse our service (spam, scraping, illegal content)
• Your account remains inactive for 2+ years (we'll email you first)

We hope to resolve any disputes amicably, but here's the formal process:

Informal Resolution

Before taking legal action, please contact us at legal@promptmaktaba.com. We'll work with you to find a solution.

Governing Law

These terms are governed by the laws of New South Wales, Australia. Any legal disputes will be resolved in the courts of New South Wales.

No Class Actions

You agree to resolve disputes individually, not as part of a class action lawsuit.

We may update these Terms of Service to reflect changes in our service or legal requirements.

How We Notify You

• Email notification: For significant changes, we'll email you at least 30 days in advance
• In-app banner: You'll see a notification when you log in
• "Last Updated" date: Check the bottom of this page for the latest update date

Your Options

If you disagree with the new terms, you may delete your account within 30 days. Continued use after the update means you accept the new terms.
